MAP Policy

Introduction

Burn Proof Gear (BPG) serves a diverse customer base, including law enforcement agencies, specialized military units, competitive shooters, and civilians. Our products are supported by a limited lifetime warranty, and our customers often express their satisfaction through social media and word-of-mouth recommendations. We recognize that our success is intertwined with that of our dealers, distributors, and marketing partners. Many of our dealers invest considerable resources to promote BPG products and ensure a positive customer experience. To protect their interests and to discourage price-based advertising, we strictly enforce our Minimum Advertised Price (MAP) Policy. Violations of this policy may result in the termination of dealer accounts and potential legal action.

Policy Statement

BPGreserves the right to cease business with any reseller that advertises any products covered by this MAP Policy at prices below the established MAP. For privacy and global MAP policy guidelines, please refer to BPG Privacy Policy.

General Guidelines

  1. Scope of Products: The MAP Policy applies to all products listed on our website, price lists, product catalogs, and any other BPG products. Prices may change at any time without prior notice. Dealers are entitled to request the current Dealer Price List once per quarter.
  2. Pricing Freedom: Dealers may sell or offer BPG products at any price they choose, provided they do not violate the MAP. BPG will independently manage its dealer and distributor networks, including marketing materials, product allocation, and promotional programs.
  3. Advertising Restrictions: The MAP Policy applies to both online and in-store advertisements. Customers may purchase products at discounted rates directly from dealers, provided that the originally advertised price complies with the MAP.

Advertising Guidelines

  1. Media Coverage: The MAP Policy encompasses all forms of advertising, including but not limited to flyers, posters, coupons, digital media, and social media platforms.
  2. In-Store Discounts: The MAP Policy applies to discounts that are advertised within the store or on-premise in addition to online advertising.
  3. Website Features: Features such as “click for price” or automated pricing communications initiated by the dealer are considered advertising under this MAP Policy.
  4. Call for Price: It is a violation to advertise that customers may “call for price” or similar phrases if the intention is to circumvent the MAP.
  5. Circumventing the Policy: Any activity deemed by BPG to circumvent the intent of this MAPPolicy, including group purchase solicitations, is prohibited unless prior written approval is obtained.
  6. General Pricing Statements: Resellers may advertise that they offer “the lowest prices” or will match competitor prices, provided they do not advertise below the MAP.
  7. Promotional Allowances: BPG may permit resellers to advertise BPG products below the MAP during specific promotions. BPG will communicate such changes and exceptions in advance when possible. The MAP holiday dates will be communicated via email and posted on our Dealer Portal prior to SHOT SHOW annually.
  8. Rebates: If a manufacturer’s rebate is offered, it is permissible to advertise the rebate alongside a MAP-compliant price, provided all conditions outlined in the policy are met.

Bundling Guidelines

  1. Bundle Discounts: If permission is granted to advertise bundle discounts, the total discount must not exceed the dealer’s purchase price unless a waiver is issued by BPG’s CEOor General Manager.
  2. Contingent Incentives: Gift cards, coupons, or incentives contingent upon the purchase of a BPG product will violate the MAP Policy if they result in an effective price below MAP.
  3. Exemptions: Rebate programs from BPG are exempt from this policy.

Policy Enforcement

  1. Multiple Locations: A violation at any store location or website associated with a dealer will be treated as a violation for the dealer as a whole.
  2. Enforcement Actions: BPG may cancel pending orders, restrict future orders, or suspend dealer accounts if there is reasonable belief of a policy violation.
  3. Determining Violations: The MAP Policy Administrator will determine whether a violation has occurred and the appropriate sanctions.
  4. Waivers: Waivers may be granted at BPG’s discretion but must be documented in writing. Personnel outside the MAP Policy Administrator are not authorized to modify the policy.
  5. Monitoring Compliance: BPG will monitor dealer pricing, and dealers are expected to cooperate with any investigations regarding MAP Policy violations.
  6. Right to Enforce: BPG reserves the right to enforce this MAP Policy at its discretion and without prior notice. Violations may result in termination of the business relationship and legal remedies.
